Right to withdraw
You have the right to withdraw with no need to explain why within 14 days.
The withdrawal period expires after 14 days:
– from the day the product/s purchased are received (if sent in one delivery), to be intended as day on which you or a third party, not the shipper and someone appointed by you, takes physical possession of the product/s;
– from the day the last of the products purchased, for an agreement for multiple products ordered by the consumer in a single order and delivered separately: «on which you or a third party, not the shipper and someone appointed by you, takes physical possession of the last product».
To exercise the right to withdraw, you must inform us of your decision to withdraw from this agreement in an explicit declaration (for example a letter sent by post or electronic mail). For that purpose you can use the standard withdrawal form attached to the general terms of the agreement.
It is understood that use of the form is not obligatory to be able to exercise the right to withdraw; as long as that desire is explicit and expressed by the term indicated above.
To comply with the withdrawal term, you just need to send the right to withdraw communication before the withdrawal period expires.
Effects of withdrawal
If you withdraw from this agreement, you will be refunded all payments made to us, including delivery costs (excluding supplementary costs due to your choice of a type of delivery that is not the cheapest standard delivery offered by us).
The refund is made without undue delay and, in any case, no later than 14 days from the day we are informed of your decision to withdraw from the agreement. Refunds will be made using the same means of payment used by you for the initial transaction, unless you should have specifically agreed otherwise. In any case, you will not sustain any cost as a consequence of that refund.
For distance sales agreements, F@ctory s.r.l., based on goods and consumer type, can establish alternatively to collect the goods at its own expense or at the consumer’s expense.
The different return method is indicated clearly and explicitly in the form summing up the order before it is sent.
Hence, F@ctory informs the consumer that, if it should not have offered to collect the goods in case of withdrawal, «the refund could be suspended until the goods are received or until the consumer proves that s/he has sent the goods back, if prior.»
Collection of goods
In a withdrawal, F@ctory s.r.l. can offer two options:
A – Collection of goods directly from the address indicated with prior contact.
B – Restitution of goods purchased and where the right to withdraw has been exercised at the expense of the consumer, who «is requested to send the goods back to F@ctory s.r.l. – Via Ottoni – 62024 Matelica (MC), without undue delay and, in any case, within 14 days of the day on which s/he communicated its withdrawal from this agreement. The term is complied with if you send the goods back before the 14 day period expires.
Costs for returning the goods
F@ctory establishes two different possibilities for returning the goods:
Option A: «Restitution costs will be our liability.»,
Option B: «Direct restitution costs will be your liability.», In that case, in the box summing up the order before it is sent, that option is indicated and the following formula must be added: «Direct restitution costs will be your liability.», The cost is estimated as a maximum of about 60.00 EUR
